This document is an electronic record in terms of Information Technology Act, 2000 and published in accordance with the provisions of Rule 3 of the Information Technology Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of “Tech-Tailor” marketplace platform – www.techtailor-uniforms.com (hereinafter referred to as "Platform").Your use of Tech-Tailor and services and tool are governed by the following terms and conditions (hereinafter referred to as “Terms of Use”). By the mere use of the website, you shall be contracting with the owner of this website, Tech-Tailor Solutions Private Limited and agreeing to the Terms of Use, Terms and Conditions, Privacy Policy and/or any other Policy. These Terms of use including the policies constitute your binding obligation, with Tech Tailor.

For the purpose of these Terms of Use, wherever the context so requires "You" or "User" or “Customer” shall mean any natural or legal person who has agreed to become a buyer on Platform by providing data while registering on the Platform as Registered User. The term "TechTailor","We","Us","Our" shall mean Tech-Tailor Solutions Private Limited and its affiliates.

When using our website and its services including but not limited to (product details, reviews etc) you will be subject to the rules, policies, regulations, terms and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use. We Reserve the Right to change, alter, modify, delete or add content to these Terms of Use at Our discretion at given point in time without providing a formal written notice to you. As long as you agree to these terms of use, we grant you a non-exclusive, personal, non-transferrable, restricted access to enter and use our platform. By browsing on our platform, you also accept the policies including but not limited to the privacy policy of Tech-Tailor Solutions as well. We reserve the right to change, alter, modify, add, delete and/or edit the content of the policies including but not limited to the privacy policy of Tech-Tailor Solutions without any formal written notice to you at our discretion at any given point in time.

1. Terms of payment –

  1. On orders exceeding 10+ units, the customer is required to pay 50% of the entire invoice amount as an advance. The remaining 50% is to be paid before delivery of the shipment at our discretion. The payment is to be made through (“insert portals of payment here”).
  2. On orders below 10 units the payment must be made in full i.e. the entire invoice amount is to be paid at the time of placing the order.
  3. 5% GST is applicable on all orders regardless of the quantity demanded.
  4. Prices are subject to change at our discretion without prior formal written notice to the customer.

2. Terms of delivery –

The Delivery Process will be initiated only when the remainder 50% of the invoice amount is realised in the accounts of Tech-Tailor Solutions.

At the time of delivery, the customer will be notified at the stages mentioned below along with the details pertaining to them –

  1. Order being dispatched from the factory - The order number along with the time of dispatch and delivery executive details will be forwarded to the customer.
  2. On arrival at the destination – The delivery executive will contact the customer to handover the shipment

3. Terms of design process – The design process consists of 4 steps which are as follows –

  1. Style finalisation – The user must confirm a selection of style from the library provided by Tech- Tailor Solutions
  2. Fabric Selection – After style finalisation, the user must confirm the fabric(s) and the colour(s) he/she wants to get the garments stitched in.
  3. Sampling- Upon Style Finalisation and Fabric Selection the user can opt for a paid/unpaid sample depending upon the quantity demanded by the user.
  4. Production – After approving the sample provided by us to the user, the order moves into production where the garments are produced in accordance to the sample approved by the user.

The order once reaching the production stage in the design process is not eligible to be cancelled under any circumstances.

4. Limitation of Liability –

In no event shall Tech-Tailor Solutions Pvt. Ltd be liable for any indirect, punitive, incidental, special, consequential damages or any other damages resulting from:

  1. The use, misuse or inability to use the platform and/or it’s services or products.
  2. Violation of agreement.
  3. Infringement, or infringement by any other user of your account with Tech-Tailor.
  4. Action or inaction on behalf of Tech-Tailor’s third-party affiliates, manufacturers, and logistic partners in providing services.
  5. Non-availability of the response/assistance from Tech-Tailor Solutions during periodic maintenance operations or any unplanned suspension of access to the Tech-Tailor Solutions.
  6. Any damage to the device(s) of the user caused by the download and processing of digital images or content provided on this platform.

To the maximum extent as permissible by the law, Tech-Tailor Solutions Pvt Ltd.’s shall be limited to the amount equal to the product purchased from Tech-Tailor Solutions.

5. Rules of Platform –

  1. As stated above, no user below the age of 18 is allowed to place an order or transact on the website. A parent/local guardian/representative over the age of 18 can place order(s) or transact on behalf of the minor.
  2. The platform is not to be operated by anyone who is not of sound mind. Any agreement made in this regard can be voidable upon the discretion of Tech- Tailor Solutions. A representative of sound mind and over the age of 18 can operate on the platform with power of attorney.
  3. The platform is the property of Tech-Tailor Solutions Pvt. Ltd and shall not be portrayed as otherwise to any other party.
  4. The user shall not conduct any malicious, illegal, deceitful activities on the platform provided by Tech-Tailor Solutions.
  5. A user shall not interfere with another USER's use and enjoyment of the Platform or any other individual's User and enjoyment of similar services provided by Tech-Tailor Solutions.
  6. A user shall not provide information that is false, inaccurate or misleading.
  7. Images used throughout the entire website are for representation purposes only. The final product and colour may slightly vary.
  8. As required by the provisions of Regulation 3(2) of the IG Rules, Tech-Tailor hereby informs you that you are prohibited from displaying, modifying, publishing, transmitting, updating or sharing any information that: a. Belong to another user or entity using the platform over which you do not have rights.

    9. b. Harms minors in any direct or indirect manner.

    c. Infringes the intellectual property of Tech-Tailor solutions and/or third party.

    d. Contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource.

    e. Impersonates another existing user or entity without power of attorney.

4. Grievance Redressal -

With respect to the SPI Rules, any grievances which you may have with respect to the information shared by you with Tech-Tailor hereunder and its treatment, may be directed by you to the office of Tech-Tailor mentioned below:

5. Cancellation Policy –

  1. The customer can cancel the order anytime before reaching the production stage (as mentioned in section 3 [iv]) mentioned in the “Design Process” and receive a refund amounting up to 75% of the amount paid for the sample if provided. The remainder will be treated as cancellation fee by Tech-Tailor Solutions.
  2. Tech-Tailor Solutions does not entertain cancellation of orders after receiving the first half of the payment as an advance.
  3. Once the order moves into the production stage the order is not eligible for cancellation.

6. Return Policy –

As the products produced by Tech-Tailor Solutions are custom made according to the user’s requirements, the garments once produced and delivered are at no point eligible for a return.

7. Termination of Access to Users –

Tech-Tailor Solutions reserves the right to terminate the access of certain users if it believes that –

  1. The user is operating on the platform provided by Tech-Tailor Solutions in bad faith.
  2. The user has infringed, breached, violated, abused, and/or unethically manipulated or exploited any term of these Terms of Service or anyway otherwise acted unethically.
  3. The user is using false e-mail address(s) or use the portal for any unlawful and fraudulent purposes, which may cause annoyance and inconvenience and abuses any policy and rules of the company or mislead Tech-Tailor Solutions by sharing multiple address and phone numbers or transacting with deceitful intentions, Tech-Tailor Solutions reserves the right to refuse access to the portal.
  4. If required, Tech-Tailor Solutions shall seek legal remedy if the infringement or violation has caused any damages to Tech-Tailor Solutions Pvt Ltd.

8. Jurisdiction of dispute settlement –

Any disputes between Tech-Tailor Solutions and the user(s) shall be subject to exclusive jurisdiction of

  1. Courts
  2. Tribunals
  3. Fora
  4. Or any other applicable authority(s) in and only in the city of Bangalore.

All disputes pertaining to Tech-Tailor are subject to exclusive jurisdiction of Bangalore only.

9. Indemnity –

The user cannot hold Tech-Tailor Solutions its -

  1. Owner(s)
  2. Director(s)
  3. Licensee(s)
  4. Employees
  5. Officer(s)
  6. Affiliate(s)
  7. Agent(s)
  8. Subsidiaries

responsible for any claims or demands including but not limited to reasonable lawyer’s fees made by third party or any penalties or fees arising out of negligence, infringement, breach and/or violation(s) of this Terms of Use, Privacy Policy and/or other Policies, or the user’s violation of any law, rules or regulations or the rights (including but not limited to infringement of intellectual property rights) of a third party.
